Gift Card Terms & Conditions

1. ISSUER AND ACCEPTANCE

Nobody’s Child gift cards (“Gift Cards”) are issued by Nobody’s Child Limited (Company No. 09567792), registered in England and Wales with registered office at 10 White Lion Street, Angel, London N1 9PD. Our VAT number is GB 216 3764 11. By purchasing or using a Gift Card, you agree to these Gift Card Terms and Conditions, which are part of Nobody’s Child’s Terms of Trade. These terms describe the contract between you (the purchaser or holder of a Gift Card) and Nobody’s Child Limited as the issuer.

2. PURCHASE AND DENOMINATIONS

Gift Cards are sold in fixed denominations and are available for purchase on our website. The maximum aggregate value of Gift Cards you may purchase is £500 per customer (this limit is to help prevent fraud and misuse). We reserve the right to decline or cancel Gift Card orders at our discretion (for example, if an order exceeds this limit or otherwise appears fraudulent). No VAT is charged when you purchase a Gift Card; any applicable VAT will be charged when the Gift Card is redeemed for goods.

3. DELIVERY AND DIGITAL FORMAT

Our Gift Cards are delivered digitally via email. No physical card is issued. You must provide a valid email address for delivery, either your own or the intended recipient’s. Please double-check the recipient’s email address before purchase – if the email is entered incorrectly and the Gift Card is delivered to someone else who redeems it, we cannot recover or reissue the value. Gift Card emails include a unique redemption code and instructions for use. Delivery is typically immediate or within a few hours of purchase (occasionally emails may filter to “spam” or “junk” folders, so please check those if not received). Risk in the Gift Card passes to you upon electronic delivery to the provided email address.

4. VALIDITY PERIOD (EXPIRY)

Gift Cards are valid for 12 months from the date of purchase (unless a longer period is stated on the card or required by law). The expiration date will be indicated in the Gift Card email or can be obtained from our customer service. After the 12-month validity period, any remaining balance will expire, and the Gift Card will be deactivated. We have no obligation to accept or honor an expired Gift Card, and any unused value at expiry will be lost. It is the cardholder’s responsibility to use the Gift Card balance before expiry. Under UK law, setting an expiry date on gift vouchers is permitted as long as it is clearly communicated to the customer. We may, at our sole discretion, offer a short grace period or reactivation of an expired Gift Card as a goodwill gesture, but we are not obligated to do so.

5. REDEMPTION AND USE

Nobody’s Child Gift Cards can only be redeemed and purchased online at our official UK website (nobodyschild.com) and are not usable in any physical store or third-party retailer. To redeem, enter the Gift Card code at checkout. Key rules for using Gift Cards include

  • Online Use Only: Gift Cards cannot be redeemed in-store or on any platforms other than our official website.

  • Multiple Cards: You may use multiple Gift Cards in one transaction. You can enter more than one Gift Card code during checkout, and all values will be applied to your order.

  • Partial Use & Balance: Gift Cards can be used for full or part payment of an order. If your purchase total is less than the Gift Card balance, the remaining balance stays on the Gift Card for future use (until expiry). If your purchase exceeds the Gift Card balance, you must pay the excess with another accepted payment method. Gift Cards can be used repeatedly until the balance is £0 or the card expires – there is no limit on the number of transactions until the value is exhausted.

  • No Change in Cash: No cash change will be given if you use a Gift Card on a purchase of lower value than its balance. The remaining balance will remain available on the Gift Card.

  • No Cash Redemption: Gift Cards cannot be exchanged for cash and have no cash value redeemable outside purchases. You cannot request any cash refund from a Gift Card (except as required by law in specific circumstances, such as a valid refund of a purchase made with the card – see no change in cash).

  • No Purchase of Other Gift Cards: You cannot use a Gift Card to buy another Gift Card or any similar voucher.

  • No Top-Up: The value on a Gift Card is fixed at purchase and cannot be reloaded or increased. Once the balance is spent, the card cannot be reused.

Gift Cards are not credit, debit, or charge cards, and they are not covered by any financial guarantee program. They simply represent a pre-paid credit to spend at Nobody’s Child.

6. TRANSFERABILITY

Nobody’s Child Gift Cards are transferrable and not personalised to a specific individual. This means the code may be used by any person in possession of it, so you can buy a Gift Card for yourself or as a gift for someone else. However, Gift Cards must not be resold or exchanged for value by the holder in any unofficial manner. We do not authorise the sale or auction of our Gift Cards through third-party platforms. Any Gift Card obtained from an unauthorised seller may be subject to cancellation. Aside from legitimate gifting or personal transfers, the commercial re-sale or trade of Gift Cards is strictly prohibited.

7. LOST, STOLEN OR DELETED CARDS

Treat your Gift Card code like cash or any other sensitive voucher. If a Gift Card (or its digital code) is lost, accidentally deleted, or stolen, or if you suspect an unauthorised person has gained access to the code, contact our Customer Service as soon as possible. While we are not legally obligated to replace lost or stolen Gift Cards, we will review cases and may, at our discretion, reissue a Gift Card to the original purchaser or intended recipient upon verification of identity, proof of purchase, and card details. Any replacement Gift Card will have the same remaining balance and original expiry date as the lost card (we do not extend the validity in case of reissue). Please note that if the Gift Card balance has already been spent by someone else prior to you reporting it lost or stolen, we cannot recover those funds or provide a refund in such cases. Our ability to reissue or cancel a Gift Card is dependent on the card not having been redeemed; once a code is used, the value is gone. We urge customers to keep Gift Card emails and codes secure and confidential.

8. REFUNDS FOR PURCHASES MADE WITH GIFT CARDS

If you use a Gift Card to purchase goods from Nobody’s Child and later return those goods or cancel the order (in accordance with our Return Policy or your legal rights for faulty items), any refund due will be credited back to a Gift Card. In most cases, we will re-credit the balance to the original Gift Card used. Where a purchase has been made using multiple payment methods, refunds will in the first instance be processed back to the Gift Card in accordance with Shopify’s Terms & Conditions (available here: Shopify Terms of Service - Shopify UK).
These automated refund allocations may be manually adjusted by Nobody’s Child at our discretion, where appropriate. If for any reason we cannot do so (e.g. technically cannot be recharged), we may, at our discretion, we will issue you a new Gift Card for the refund amount. Refunds for purchases made with Gift Cards will not be given in cash under any circumstance. The refunded amount on a Gift Card will not extend the original expiry; it will retain the same expiry date as the initial card credit, or the expiry of the new Gift Card issued will be the same as the original card’s remaining term. For example, if you bought an item with a Gift Card that was due to expire in two months and you return the item, the credit will go back onto the card (or a new card) which will still expire when the original card was set to expire. This ensures that using a Gift Card for a purchase and refund does not unfairly extend the validity period. These refund rules do not affect your statutory rights for returning products. In cases of faulty or misdescribed products, your rights to a remedy (refund, repair or replacement) apply just as if you had paid by other means, but any agreed refund will still be applied to a Gift Card rather than cash.

9. COOLING-OFF CANCELLATION (ONLINE PURCHASE ONLY)

If you purchase a Gift Card online (as an e-gift card), you have a legal right to cancel the gift card purchase within 14 days of receiving the Gift Card email/code, provided the Gift Card has not been used in that time. This 14-day “cooling-off” period is provided under the UK Consumer Contracts Regulations for distance sales. The cancellation period ends 14 days after the day you (or your designated recipient) received the Gift Card code via email. To exercise this right, you must inform us of your decision to cancel within the 14-day period (for example, by contacting our Customer Service through the link on our website or by email and providing your order details and Gift Card code). We will then deactivate the Gift Card code to prevent any use. Within 14 days of you notifying us of cancellation (and provided the card was not redeemed), we will refund you the full purchase price of the Gift Card. The refund will be made to the original payment method you used to buy the Gift Card. Because our Gift Cards are digital, there is no physical card to return; however, if you have printed the e-gift or forwarded it, please inform the recipient not to use it once you decide to cancel. Important: If any amount of the Gift Card was spent (even partially) during the 14-day period, then the cooling-off right is lost and you cannot cancel the purchase (by using the Gift Card, you are deemed to have started using the service, which waives the right to cancel). This cancellation right for Gift Card purchase is separate from and in addition to your rights regarding returns of any goods you purchase with the Gift Card.

10. FRAUD, ABUSE AND CANCELLATION BY US

We reserve the right to decline, void, or cancel a Gift Card (and/or suspend the associated code) if we suspect fraud, tampering, unauthorised use, or any violation of these terms. For example, if we have reason to believe a Gift Card was obtained illegally (such as through credit card fraud) or has been altered, duplicated, or used in a fraudulent manner, we may cancel the Gift Card without notice and without a refund, except possibly to the original purchaser in cases of proven credit card fraud. We may also refuse to accept a Gift Card in payment if the code is invalid or not legitimately issued by us. Nobody’s Child reserves the right to cancel any Gift Card or voucher in its sole discretion where fraud or misuse is suspected. We further reserve the right to take appropriate legal action in cases of fraud, attempted fraud, or breach of these terms. Prohibited actions include but are not limited to: using a Gift Card in any manner not permitted by these terms, selling a Gift Card on an online auction or marketplace, or hacking/altering the email or code. Engaging in such activities may result in the Gift Card being voided.

11. OTHER IMPORTANT TERMS

Gift Cards are a form of prepayment for our goods and are not covered by the Financial Services Compensation Scheme (FSCS) or any bank deposit guarantee In the unlikely event that Nobody’s Child becomes insolvent or ceases trading, Gift Card holders may be treated as unsecured creditors, which means funds on a Gift Card are not guaranteed to be refunded. Gift Card balances do not earn interest, and there are no fees associated with holding or using a Gift Card (we do not charge any service fees for maintenance of the card). These Gift Card Terms and Conditions are governed by the same law and jurisdiction clauses outlined in our general Terms of Trade (generally, English law will govern, and English courts will have jurisdiction, unless otherwise mandated by your local laws if you reside elsewhere in the UK). We may update or amend these Gift Card terms from time to time. Any changes will not affect Gift Cards already purchased to the extent such changes would unfairly deprive you of rights, and material changes will be communicated or posted on our website. If you have any questions about these terms, please contact our customer service for clarification. Nothing in these terms affects your statutory rights as a consumer under UK law.
